Welcome to Proxy Pen. By accessing or using our services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

1. Acceptance of Terms

By creating an account, accessing our website, or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2. Description of Services

Proxy Pen provides written services designed to improve personal and/or business visibility using media, AI platforms and search engines.

3. User Accounts

3.1 Account Creation

To use our services, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials.

3.2 Account Responsibilities

You must be at least 18 years old to use our services
You are responsible for all activities you might adjust within your account
You may not share your account with others

4. Payment and Billing

4.1 Fees

You agree to pay a 25% deposit for initial layout of any published book, memoir, or course. You will have 3 business days to accept the draft once presented, or request a refund. Upon acceptance, 25% of the total is due at this time, and is non-refundable. The remaining balance is due upon acceptance. All other services; email campaigns, newsletters, etc., have fees associated with your selected service plan. Fees are charged in advance and are non-refundable except as required by law or as explicitly stated in these Terms.

4.2 Payment Methods

We accept various payment methods as listed in your agreement. You authorize us to charge your selected payment method for all fees incurred.

4.3 Automatic Renewal

Unless you cancel before the end of your billing period, all subscriptions will automatically renew at the then-current rate. All subscriptions are billed monthly in advance, regardless if the content is created daily, weekly, bi-weekly, or monthly.

4.4 Refund Policy

Refunds are provided at our discretion or as defined in your contract/agreement. If you are unsatisfied with our services, please contact us within 7 days of purchase to discuss potential refund options.

5. Use of Services

5.1 Acceptable Use

You agree to use our services only for lawful purposes and in accordance with these Terms. You agree not to:

Share your content for use with any other business other than the business stated on your contract with Proxy Pen.
Violate any applicable laws or regulations
Infringe on intellectual property rights
Transmit malicious code or viruses
Attempt to gain unauthorized access to our systems
Use our services to harm, threaten, or harass others
Engage in any activity that disrupts our services

6. Intellectual Property

6.1 Our Content

All content, features, and functionality of our services, including but not limited to text, graphics, logos, and software, are owned byProxy Pen and protected by intellectual property laws.

7. Service Guarantees and Limitations

7.1 No Guarantee of Results

While we strive to improve your visibility, we cannot guarantee specific rankings or business outcomes. Results may vary based on numerous factors beyond our control.

7.2 Service Availability

We aim to provide uninterrupted service but do not guarantee that our services will be available at all times. We may suspend or terminate services for maintenance, updates, or other reasons.

8. Limitation of Liability

To the maximum extent permitted by law, ProxyPen shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of our services.

9. Indemnification

You agree to indemnify and hold harmless ProxyPen and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from your use of our services or violation of these Terms.

10. Termination

10.1 Termination by You

You may cancel your account at any time through your account settings or by contacting us. Cancellation will be effective at the end of your current billing period.

10.2 Termination by Us

We reserve the right to suspend or terminate your account if you violate these Terms or engage in conduct that we deem harmful to our services or other users.

11. Modifications to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of our services after such changes constitutes acceptance of the modified Terms.

12. Modifications to Services

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time, with or without notice.
